Terms, plainly stated.

These terms govern your use of Marked’s financial data, API, MCP server, dashboard and related services.

1. Agreement and operator

By using Marked, you agree to these Terms and our Privacy Policy. Marked is based in India and is operated under the Marked name. We will update these Terms if the operating entity or contact details change. Questions and notices go to [email protected].

If you use Marked for an organization, you confirm that you can bind that organization to these Terms. A written customer agreement controls if it conflicts with these Terms.

2. Eligibility and accounts

You must be legally able to enter a contract where you live and must provide accurate account information. Keep your sign-in details secure and tell us promptly about unauthorized access. You are responsible for activity under your account and workspace, except to the extent caused by our breach of these Terms.

3. Intended use: data, not advice

Marked provides structured information about Indian capital markets, including data from exchanges, filings and other sources. Data may be delayed, incomplete, changed, restated or unavailable. Verify important information against authoritative source material before relying on it.

Marked is a data layer only. We are not an investment adviser, broker, dealer, research analyst, tax adviser or financial planner, and we do not provide personalized investment recommendations or other financial advice. Marked does not hold itself out as a SEBI-registered investment adviser. India’s investment-adviser framework is available from SEBI.

You are responsible for interpreting and verifying the data, making your own decisions, and obtaining any registration, license or professional advice required for your use. If you build an advisory or recommendation product, you are responsible for determining and meeting the laws and regulatory requirements that apply to you.

4. Acceptable use

You may use Marked only lawfully and in accordance with these Terms. You must not probe or attack our systems, bypass limits or authentication, interfere with service operation, overload infrastructure, share credentials or keys, scrape beyond documented access, reverse engineer non-public components, infringe rights, or use Marked to facilitate fraud, market manipulation or other unlawful activity.

We may investigate misuse and suspend or restrict access when reasonably necessary to protect users, data, the service or legal rights.

5. API keys and integrations

API keys are credentials. Store them securely, do not expose them in client-side code or public repositories, and rotate or revoke them when compromised. You are responsible for requests made with your keys. Third-party clients, models, hosting providers and integrations remain subject to their own terms and privacy policies.

6. Your content and limited telemetry

You keep your rights in content you submit. You grant Marked the limited permission needed to process that content in memory, return results, secure the service and provide support. By default, Marked does not retain raw prompt text, output text, request bodies, query values or uploaded files.

To operate, protect and improve reliability, Marked may retain limited usage metadata such as the endpoint or tool, dataset or query category, parameter names, response status, latency and date. We do not use this metadata to reconstruct prompts, sell personal information, conduct cross-context behavioural advertising or train a general-purpose AI model. Marked does not offer raw prompt or output capture for product improvement. More detail is in our Privacy Policy.

You must have the rights and permissions needed for content you submit, including personal information about other people. Do not submit secrets or highly sensitive information unless the service expressly requires it.

7. Sources, licenses and intellectual property

Marked and its software, documentation, branding and improvements belong to Marked or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service for its documented purpose. Source datasets and filings may have their own rights, notices and redistribution restrictions. You are responsible for complying with them and for preserving required attribution.

8. Plans, fees and access

Any plan, quota, fee or payment terms shown in an order, invoice or pricing page apply to that purchase. Unless required by law or stated otherwise, fees are non-refundable. We may change plans or limits prospectively with reasonable notice. We may suspend or end access for non-payment, misuse, security risk, legal requirement or service discontinuation.

Developer, Builder and Scale subscriptions do not grant commercial-use, commercial-deployment, resale, redistribution or customer-facing rights to Marked data, outputs or services. Those rights require a separate Enterprise agreement signed by Marked. Enterprise terms control the scope of any commercial license, including permitted products, users, territories, sources and redistribution.

You may stop using Marked at any time. After closure, we may retain information where needed for security, legal, accounting or dispute purposes, as described in the Privacy Policy.

9. Disclaimers and liability

To the maximum extent permitted by law, Marked is provided “as is” and “as available”. We do not promise uninterrupted availability, error-free data, a particular result or fitness for a particular purpose. Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or willful misconduct.

To the maximum extent permitted by law, Marked will not be liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, trading losses, data loss or business interruption arising from use of the service. Our total liability for claims arising from the service will not exceed the greater of the fees you paid to Marked for the relevant service in the three months before the event or INR 10,000. If you use Marked as a business, you agree to indemnify Marked against third-party claims caused by your unlawful use, submitted content or breach of these Terms.

10. Governing law and contact

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India having jurisdiction over the operator’s location will have exclusive jurisdiction, except where mandatory law gives you another forum.

We may update these Terms when the service or law changes. The effective date above will change, and we will provide notice where required. Contact [email protected] with questions or legal notices.
